Rules of origin / Free trade agreements

There are several origin rules which are related and linked to the duty free or preferential duty goods trade:

 

  • Origin in the range of free trade agreements (preferential origin)
    Switzerland has concluded free trade agreements with several countries. The preferential treatment of these agreements applies only for the goods, which meets the required origin criteria.

  • Origin in the range of general preferential system for developing countries (ASP/GPS)
    The general preferential system in favor of the developing countries goes back to a resolution of the United Nations conference for trade and development (UNCTAD). The participation to the world trade for the developing countries will be facilitated and from side of the industrial nations unilateral customs preferences will be granted

  • Non preferential origin
    The non preferential origin will be applied where at time of goods importation/exportation measures of foreign trade will be used. (i.e. anti-dumping fees, compensation fees, trade embargoes etc.). It is not related to the customs preferences (preferential origin)

  • Indications of origin on goods
    Indications of origin on goods on the products are information about the geographical origin of the goods. Between the origin rules prescribed by customs law and the rules for the geographical indications of origin on goods according to the trademark protection law there are significant differences. The geographical indications of origin on goods belong to the law of labeling. This is prescribing that the used origin information must be correct.

The free trade agreements are differing between four main categories:

  • Multilateral agreements
  • Bilateral agreements
  • Agreements in the pan-european free trade system
  • Agreements in the pan-euro-mediteranien free trade system

 

For all these agreements it is very important that the commercial invoice, which will be attached to the shipment, shows the correct and valid origin declaration. Only in this way, it will be ensured that the importer of the goods will benefit from the customs duties deduction and/or exemption. If the shipper is not an authorized exporter, and if the value shown on the invoice exceeds a certain amount, an EUR.1 or EUR.MED must be issued and be attested by the local chamber of commerce.
